SC nominations withdrawn by Justice Qazi Faez Isa

The Chief Justice of Pakistan (CJP) Umar Ata Bandial was urged on Sunday by SC Justice Qazi Faez Isa to withdraw the names of junior court judges, who have already been rejected by the Judicial Commission of Pakistan (JCP) for elevation to the SC.

He requested that the CJP consider the names of the chief justices of the five high courts or, as proposed by two Hon’ble Members, the chief justices together with the senior-most judges of the five high courts, otherwise, let this be the agenda for the next meeting.

A day earlier, the superior courts strongly objected to three junior judges of the high courts being elevated to the supreme court.

Out of 17 judges, the top court is currently short five.

There have been recommendations for the elevation of judges from the Islamabad High Court to the Lahore High Court to the Sindh High Court’s Justice Syed Hasan Azhar Rizvi and Justice Shafi Siddiqui.

There has been no appointment of a SC judge since February this year. As a result, the JCP could not reach a consensus on the five nominees proposed by CJP Bandial on July 28.

Moreover, the letter further pointed out that Justice Bandial contradicted himself in his note when he said that the JCP’s meeting would be resumed on October 24, 2022.

The meeting on October 24 is to consider three junior judges and the Chief Justice of the Islamabad High Court, he wrote.

The JCP’s credibility and integrity are undermined by presenting the names of three junior judges whose nominations have already been rejected.

Despite occupying a room adjacent to Bandial, Justice Isa claims the CJP did not consider it appropriate to discuss or inform him of what he is proposing.

A WhatsApp message he sent mentioning that JCP members rejected the nominations was reproduced to remind the CJP.

The chairman and all members received his message of July 28, 2022, but no one responded to it.

An audio recording of the last meeting of the JCP was also objected to by Justice Isa.

“Instead, the Chair issued a press release through the Supreme Court PRO, to which I replied: “I have learned that you have issued this press release unapproved and unilaterally through the PRO behind our backs.”. Does he belong to the JCP? ’” stated Justice Isa.

He then stated that the chairman then issued another press release, to which he responded, “I now learn that you’ve issued another press release and once again behind our backs.”

Justice Isa furthered that the chairman had “misused his office by issuing the two press releases”.

He added that it was not disclosed that the meeting was being secretly recorded and that permission was not sought from the JCP before releasing the audio recording of the meeting.

The JCP meeting is set to be held tomorrow (October 24) to consider nomination of four high courts judges regarding their elevation to the top court.
